Court says Net music subpoenas not allowed

According to the article:

"...in a strongly worded ruling, the appeals court sided with Verizon, saying a 1998 law does not give copyright holders the ability to subpoena customer names from Internet providers without first filing a formal lawsuit.

"In sum, we agree with Verizon that (the law) does not by its terms authorize the subpoenas issued here," Chief Judge Douglas Ginsburg wrote."

InternetMovies.com vs. MPAA Appeal Draws RIAA, ICC, and NetCoalition to File Amicus Briefs, Says InternetMovies.com

"Now teaming up with the MPAA is the Recording Industry Association of America (RIAA). RIAA informed the Fosbinders, attorneys for InternetMovies.com, they are filing an amicus brief. A joint amicus brief was filed in favor of controlling the abuse of "good faith belief" from Internet Commerce Coalition (ICC), and NetCoalition.com (http://www.internetmovies.com/legal.html). ICC members include AT&T, BellSouth, eBay, MCI, Verizon and more. NetCoalition members include Yahoo!, Lycos, Inktomi and others (http://www.netcoalition.com/who/). Jim Halpert, of the ICC helped draft the Digital Millennium Copyright Act (DMCA)."

Philips & Sony To Purchase Intertrust DRM Tech

""Reuters is reporting that Philips and Sony Corp, the parents of the compact disc, teamed up on Wednesday to buy InterTrust Technologies for $453 million -- a deal expected to speed up copyright security for digital media. The acquisition by Philips Electronics and Sony of the leading U.S.-based holder of intellectual property in the field of 'digital rights management' technology is widely seen as a way to prevent Microsoft, which has been embroiled in a legal battle with InterTrust, from grabbing control of the potentially lucrative business. Philips and Sony, the electronics giants who introduced the CD format 20 years ago, said the deal would enable secure distribution of content as more films and music are sold over the Internet and other media in digital format.""

Congressman Seeks Change in Digital Subpoenas

"A leading tech-corridor ally in Congress has told Billboard he will support new legislation that will further endear him to that constituency.

During the next session, Rep. Rick Boucher, D-Va., will support a bill that seeks to modify the "information subpoena" and lawsuit mechanism granted by the Digital Millennium Copyright Act (DMCA). That is what the recording industry employs to go after those who infringe upon copyrights with illicit peer-to-peer file sharing."
